Undoubtedly, artificial intelligence technologies hold significant potential to substantially transform criminal proceedings in the future. Technological progress, rapid development of AI and available opportunities for its training necessitate the integration of AI into criminal proceedings to optimize, accelerate and simplify individual procedural actions, thereby enhancing the overall efficiency of criminal procedural activities. As an assistant AI will enable judges to consider the diversity of judicial practice and legal positions established by the Supreme Court of the Russian Federation with minimal time expenditure.
The presented research is among the first to address practical issues concerning the development of an algorithm for training AI to draft court rulings on the selection of preventive measures and to verify such rulings based on specially selected judicial decisions. The outcomes of this work already allow us to glimpse the future of criminal proceedings, where AI technologies will become widely adopted. An AI assistant could be employed by courts to account for specific features related to the pre-trial detention of suspects and accused persons. The developed algorithms may assist courts in conducting criminal procedural activities regarding the selection of preventive measures while ensuring compliance with requirements stipulated by criminal procedure legislation.
At the same time emphasis is placed on the fact that AI cannot independently issue legally binding rulings on the application of preventive measures and must not make decisions instead of the judge. Nevertheless, creating and practically implementing an AI assistant for judges during the selection of preventive measures will reduce the time spent by courts and improve the quality of their decisions.
The project aims to train AI both to draft preliminary versions of court rulings on selecting preventive measures and to verify similar rulings issued by courts. Areas of AI application include serving as a judge’s assistant during the selection of preventive measures, as a defense attorney’s tool when preparing appeals against court rulings on preventive measures and as an educational instrument for instructors helping students develop practical skills in drafting rulings on preventive measures.
