Abstract

The article examines the trend towards ‘nationalisation’ of jurisdiction in Russian law as a response to the diminishing availability of legal protection abroad. Based on the analysis of legislation, judicial practice and the legal positions of the Constitutional Court of the Russian Federation three dimensions of this process are identified: the development of procedural anti-sanctions mechanisms (Art. 248.1 and 248.2 of the Russian Arbitrazh Procedure Code), the expansion of arbitrazh court jurisdiction over cross-border insolvency of foreign persons and the broadening of notarial and judicial competence in international succession cases through the doctrine of forum necessitatis. The advantages and risks of unilateral jurisdictional expansion are assessed, leading to the conclusion that these measures are of a forced and transitional nature.
